Each year in Hot Springs, Arkansas, a grand event takes place. Every April at the Oaklawn Park, home of the Racing Festival of the South, thousands of people gather to see this American Thoroughbred horse race. Handicap racing, one of the forms of thoroughbred racing, is when each horse is assigned a different amount of weight to carry based on their ability. In addition to the weight each horse is carrying, they also have other factors that influence the outcome. For example, the talent of the horse trainer or jockey plays a vital role in how well the horse will do. Also, the gender of the horse and his/her personal traits has its own impact. Other factors in the mix are closeness to the inside of the barrier, and the track itself, all these being key components to horse racing. Graded stakes race, a term that describes races that derive their name from the stake, or entrance fee the owners pay. The track also adds to the stake which is paid in prize money to the race’s winners.
 
Of the 65 thoroughbred race tracks, Oaklawn Park was ranked #9 in 2009. The race began in 1958, was repeated in 1963, and then run every year after that. Until 1973, it was a handicap race. It then became a Graded stakes race. The type of horses in the race are fillies and mares, four years or older. The setting is a left handed dirt track usually 8.5 furlongs or 1 1/16 miles long. Over the years this distance has changed. In 1958, and 1980-2009 it was 8.5 furlongs. In the year 1963 and 1968-1974, it was only 6 furlongs. Between 1975-1979 it was 8.32, and the last one held in 2010, was 9 furlongs.
 
The owner of Oaklawn Park is Charles J. Cella. He owns the Oaklawn Jockey Club Inc. and operates the track, the business being in his family for three generations. In 2010 Cella announced a new possible change. Winner of the race takes a purse of $500,000, and after negotiating with the two leading females in the U.S. in 2009, he offered a purse increase to $5 million if the horses, Rachel Alexandra and Zenyatta would start in the 2010 race. If both were willing, the race would have been 9 furlongs long. If one was not, the purse would remain $500,000 and revert to the original distance of 8.5 furlongs long. Both agreed to Cella’s offer as long as the health of their horses remained well. However, on March 14, 2010, after a race ran by Rachel Alexandra, it was announced she was not in top form to compete in the Apple Blossom Handicap 2010.
 
The winner of the race in 2010 was Zenyatta, whose jockey, Mike Smith, has also earned ‘Most wins by Jockey’ for this race. He has tallied up six wins in years 1994, 2002, 2003, 2004, 2008 and 2010. The last two wins were with the horse Zenyatta. One of the horses he rode also took ‘most wins’ – Azeri, winning in years 2002, 2003 and 2004

A grade 3 event, the Tom Fool Handicap race came into existence as an honour paid to one of the finest thoroughbreds from the world racing history, Tom Fool, who was ranked 11 by the Blood-Horse magazine for his amazing performance as a potential thoroughbred highly renowned for his supremacy over many contenders of his generation.

The handicap race started in the year 1975, just a year before Tom Fool’s demise. The race open to three year olds and up is run for six furlongs and offers prize money of $150,000. Run annually at the Aqueduct in the first quarter of the year, the record performance has been achieved by Calibrachoa in 2011; previous record performance was accomplished by Left Bank in 2002 when the race was run at 7 furlongs.

The recognition of honouring Tom Fool with a thoroughbred race happened due to his excellence at racing as well as at siring. Tom Fool sired as many as 30 stakes winners which include U.S. Horse of the Year 1966, Buckpasser; Triple Crown races winner Tim Tam and leading two year old and sire Silly Season.

Tom Fool’s career was one that sported a good 30 starts in a career of three years with only one out of money finish. He won 21 races, finished second in 7 and third in 1. His first racing year as a Two-Year-Old saw him competing in 7 races in all; he won five of them and finished second in 2. This brought him to instant limelight as he won the Champion Two Year Old Colt for 1951.

Having finished second in the 1952 Wood Memorial Stakes, one which was greatly anticipated to be an obvious win for the three year old, Tom Fool underwent a veterinarian check-up that revealed he had contracted fever and had contended for the race while still ill. The bad health kept him out of many prominent races including the Triple Crown. However with his comeback almost a couple of months later, Tom Fool went on to win the Jerome Handicap and finish third in the Travers. He also won the Empire City Handicap and pulled of a twelve race in the money finish in a season of thirteen starts.

He started once again as a four year old and avenged his Triple Crown absence with a win at the New York Handicap Triple Crown winning all three Metropolitan Handicap along with the Suburban and Brooklyn Handicap. Tom Fool was awarded the Horse of the Year award for his incredible performance as an older horse. 1965, he was also a leading sire in Britain and Ireland. Blood-Horse magazine ranked him 11 and the Hall of Fame inducted the racer in 1960.

Construction Workers Welfare Legislation in India

India has enough Labour legislation but due to lack of political will and timely implementation, such legislation remains on the statute book without having its force. The Building and other Construction Workers (Regulation of Employment and conditions of Service) Act, 1996 and The Building and other construction workers’ Welfare Cess Act, 1996 are the glaring example. These twin Acts were passed by the Parliament in the year 1996 and subsequently “the building and other construction workers’ (Regulation of employment and conditions of service) central Rules and The Building and other construction workers welfare Cess Rules were framed. More than 15 years these two Acts are not fully implemented.

In building and other construction works more than tens of millions of workers are engaged, who are exposed to higher risk of life and limb. These workers are one of the most vulnerable segments of the unorganized labour and don’t get basic amenities and social security. These twin Acts were enacted with an object to regulate the employment and conditions of the service of building and other construction workers and to provide for their safety, health and welfare measures.

The scheme of the BOCW (Regulation of Employment and conditions of Service) Act, 1996 is that it empowers the Central Government and the State Governments to constitute Welfare Boards to provide and monitor social security schemes and welfare measures for the benefit of the building and other construction workers. As per the section 1(4) the BOCW Act applies to every establishment which employs, or had employed on any day of the preceding twelve months, ten or more building workers in any building or construction work. Section 2 (d) of the Act defines “the building and other construction works”. Section 7 of the Act requires every employer in relation to an establishment to which the BOCW Act applies to get such establishment registered. Section 10 makes this requirement mandatory and therefore, without such registration, the employer of an establishment, to which the BOCW Act applies, cannot employ building workers.

Chapter IV of the BOCW Act contains provisions stipulating the registration of building workers as beneficiaries and requires certain contributions to be made by such beneficiary at such rate per month as may be specified by the State Government. Where the worker is unable to pay his contribution due to any financial hardship, the Board can waive the payment of such contribution for a period not exceeding three months at a time.

Section 18 sets out the constitution of State Welfare board. Under the provision of the section 18 every State Govt. is required to constitute the Welfare Board. Section 22 stipulates the provisions regarding functions of the Building and Other Construction Workers’ Welfare Boards. Section 24 sets out the provision for the constitution of the Welfare Fund and its application.

Chapter VI of the BOCW Act contains provisions relating to the safety, health and welfare of the construction workers.

The Building and other construction workers’ welfare Cess Act’1996 was enacted with an object to provide for the levy and collection of a Cess on the cost of construction incurred by the employers with a view to augmenting the resources of the Building and other construction Workers’ welfare Boards constituted under the section 18 of the Building and other construction Workers’ (Regulation of Employment and Conditions of Service) Act’1996.

Section 3 of the BOCW Cess Act setout the provisions for levy and collection of Cess at such rate not exceeding two percent, but not less than one percent of the cost of the construction incurred by the Employer. Rule 4 of the Building and other construction workers’ welfare Cess Rules, 1998 makes it mandatory for deduction of Cess payable at the notified rates from the bills paid for the building and other construction work of a Government or a Public Sector Undertaking. Rule 5 prescribes the manner in which the proceeds of Cess collected under Rule 4 shall be transferred by such Government office, Public Sector Undertakings, local authority, or Cess collector, to the Board. The powers of the Assessing Officer and the Board of Assessment are enumerated in Rules 7 to 14 of the Cess Rules.

Although the twin Acts were enacted in 1996, but a majority of states failed to implement the Building and Other Construction Workers (Regulation of Employment and Condition of Service) Act, 1996, and the Building and Other Construction Workers Welfare Cess Act, 1996 untill 2002, when Government of NCT of Delhi constituted the Delhi Building and Other Construction Workers Welfare Board vide Notification No. DLC/CLA/BCW/02/596 dated 2nd September, 2002. A PIL was filed by an NGO National Campaign Committee for Central Legislation on Construction Labour’ (NCC-CL) in the Supreme Court for implementation of the Twin Acts.

On the direction of the Supreme Court issued in the matter of National Campaign Committee for Central Legislation on Construction Labour’ (NCC-CL) most of the states has constituted the Labour Welfare Board and started collecting Cess @ 1% of the Construction Cost where the construction cost is more than 10 Lacs.

The constitutional validity of the BOCW Act was also challenged by the Builders Association in the Builders Association of India vs Union of India, (2007) 139 DLT 578. The Division of the Delhi High court upheld that the BOCW Act, the Cess Act, 1998 Central Rules and the 2002 Delhi Rules were constitutionally valid.

The supreme court of India in civil appeal no. 1830 0f 2008 entitled M/S. Dewan Chand Builders Contractors versus Union of India  has also upheld the constitutional validity of the twin Acts.

Although the Supreme Court has upheld the constitutional validity of the twin Acts but the issue regarding effective date of the Cess Act is still unresolved. The Supreme Court in Dewan Chand Builder Case a view has been taken that the Cess Act and the Cess Rules are operative in the whole of NCT of Delhi w.e.f. January, 2002. But in SLP (C) 33486-33488 of 2011 Supreme Court has observed that the as per Section 1(3) of BOCW Act provides that the Act shall be deemed to have been come into force on 1st day of March’1996.

On concluding note it can be said that implementation of twin Acts has been a major concern. A critical factor impeding effective implementation is lack of political will of the state authorities and influence of builders lobby on them.

Proper Care For Horse Saddles – leather – EzineMark

Maintaining your horse’s saddle is a top priority. Since saddles are usually made of leather, they require quite a bit of attention to make sure that they last and that you get you money’s worth out of them.

Cleaning your saddle on a monthly basis will help keep maintenance minimal and prevent the hefty job of undoing long term neglect. If you use your saddle on a more regular basis, you may need to tend to it more frequently. Saddles have a long lifespan in general, but if they are not cared for they can rot and deteriorate rapidly. It is also always important to use some sort of leather oil when caring for your saddle once you have cleaned it. This will help to preserve the leather. You can straddle your horse saddle over a fence to scrub it. You may use water and a mild soap to begin cleaning, but do not soak or saturate the leather too deeply. You can use a medium soft brush to scrub the leather, but be careful not to shred or tear it.

If you can dismantle the saddle to clean it, that would be ideal. Dirt and molds can build up in nooks and crannies. These can at the worst make you or your horse ill and at best cause quite a foul odor. It is always a good idea to do a thorough job of cleaning your horse’s saddle, rather than saving time by skipping the detail work. While you are scrubbing the main part of the saddle, soak the detached metal parts that are safe to soak. You will be finishing these later. Do not leave them soaking longer than it takes to clean the rest of the horse saddle. Do not soak any leather! Remember that the horse is in contact with the underside of the saddle, so do not forget to clean this part as well. You will also need to clean all straps and harnesses and any metal pieces that are connected to the saddle core. Be sure these are allowed to dry before the saddle is stored to prevent rusting.

After cleaning the saddle with soap and water, apply a leather protector to the leather of the saddle and oil all of its metallic parts. Spread the oil well over the entire saddle and do not allow it to dry in drips. This will permanently discolor the saddle. Once you have oiled your saddle and thoroughly dried off all of the leather and metallic parts, it is time to reassemble your saddle, Hopefully, you have kept careful track of all the parts that you detached. Do not leave any parts out when putting it back together or the saddle may fall apart or fail during use. It is essential to maintaining the lifespan of your saddle that you give it proper care and attention on a regular basis. Like maintaining your teeth or the the finish on a car, there are both aesthetic and functional purposes for good maintenance on a horse saddle. Rust and rot makes metal and leather brittle, mold and fungus can make you or your horse sick, etc. So take care of your horse and yourself by taking care of your horse saddle.

The history of Formula 1 pit girls can be traced back to horse racing, where paddocks were used to cover the horses prior to races. Then it was shifted to girls holding paddocks over riders as they readied for a race. This transitioned into early MotoGP races, where in Asia, Paddock girls shielded racers from the sun as they prepped for race—something that took several hours and helped prevent the riders from suffering from heatstroke.

 

When advertising merged with paddock girls, pit girls were officially born. Today, Formula 1 pit girls are not just there for their sultry good looks – and good looking they truly are – but they also represent different major brands and are ambassadors to certain product lines, many of which are household names. And the Melbourne Formula 1 pit girls actually wear the classiest outfits of the bunch by comparison…but is this really a good thing?

 

As opposed to flaunting the cleavage touting and promiscuous outfits that have become the presumed apparel for all Formula 1 pit girls, the Melbourne Formula 1 pit girls beg to differ. At the Australian F1 Grand Prix, they have enacted newer regulations on the attire that is deemed as acceptable for pit girls. All of the models on the track now wear the less visually stimulating outfits that were created and designed by fashion designer Kit Willow.

 

In a statement to the press, Willow emphasized the desire to make formula 1 pit girls’ outfits classier and more refined in their couture. “It was about injecting elegance and style into the pit […] about teetering between and sympathizing with the usual Grand Prix grid-girl look,” Willow explained of the outfit design.

 

Critics have expressed their dismay, with one fashion designer flat out stating that the outfits are not attractive at all, and questioning just what the designer and the Grand Prix committee were thinking. The neckline on the outfits is short and a black blouse covers any areas of the bosom, complete with knee-high leather boots and a black top hat. Hardly what you would expect from Formula 1 pit girls; it is something that you should expect to see, however, if you find yourself in Melbourne at the pro F1 tracks any time in the near future.

Individual value systems are not primarily about wealth, in fact the eminent psychologist Abraham Maslow constructed a hierarchy of needs pyramid, starting with food and shelter and progressing to self actualization. Our goals in a negotiation vary depending on current needs within Maslow’s hierarchy, desires for the tangible, and verification of intangibles such as social recognition. The purpose of negotiation is acquiring satisfaction by receiving greater value than given – this is true for both involved parties.

Society has changed dramatically in the last few centuries. Unfortunately our emotions remain locked at a tribal relationship level. As a tribal member our ancestors would have lived as an extended family while fighting for survival. If I shared my meal with you, I lost – you gained, but our tribe was stronger and I was safer for it. If another tribe entered our forest, we fought for our territory. In scarcity the rule is win-lose. When wars, poverty, and famines were the rule; group action was a requirement for survival.

As a tribal member our ancestors would have lived as an extended family while fighting for survival. If I shared my meal with you, I lost – you gained, but our tribe was stronger and I was safer for it. If another tribe entered our forest, we fought for our territory. In scarcity the rule is win-lose. When wars, poverty, and famines were the rule; group action was a requirement for survival.

Since the industrial revolution a new philosophy of relationships has become available. Win-win does not work in scarcity, but in abundance. With each win-win interaction wealth is created, wealth that becomes available to all by reason of exchange. That creates a win-win-win opportunity every time free exchange is initiated. This does not feel natural to a tribal mind, nor can it be grasped by an educated mind that clings to a-priori reasoning.

Let’s make it simple.

The shoe industry temporarily prospers – and those that receive their political donations. The government also keeps the tariff money as another hidden tax. After years of numbing protection; having no need to innovate, and rife with growing inefficiencies, the local shoe industry will be allowed to quietly die. Everyone but those in power has paid for fair trade favors given to the few. Some immediately – others will pay later.

Free trade in contrast benefits all, you get what you want for what you want to pay, or you find another supplier. If there is no reasonable supplier but a perceived demand, you can develop a marketable solution. Innovation and efficiency are rewarded. Prices go down, quality goes up. Lifestyles will improve for generations. Simple!
